General Terms and Conditions

These General Terms and Conditions govern the details of the booking and implementation of the study programs and certificate courses offered by the Scheer School of Digital Sciences at Saarland University gGmbH, which can be viewed in detail on the homepage of the Scheer School of Digital Sciences at Saarland University gGmbH(https://www.scheer-school.com/unsere-programme/)(hereinafter also referred to as “training and further education offer”). Deviating general terms and conditions are not recognized unless they are expressly approved by the Scheer School of Digital Sciences at Saarland University gGmbH. In particular, deviating general terms and conditions are not recognized even if reference is made to them and the Scheer School of Digital Sciences at Saarland University gGmbH has not expressly objected to them.

  1. Organizer and participants

1.1 Organizer

The organizer of the training and further education offer within the meaning of these General Terms and Conditions is the

registered in the commercial register of Saarbrücken Local Court under HRB 110624.

1.2 Participants

Participants within the meaning of these General Terms and Conditions are those natural persons who take part in the training and further education offered by the organizer. However, for the purposes of these General Terms and Conditions, participants in this sense also include those natural or legal persons, partnerships or other legal entities in whose name or for whose account participation in the training and further education program takes place.

  1. Registration, conclusion of contract and admission requirements

2.1 Registration

Registration is possible via the online forms provided on the organizer’s homepage (https://www.scheer-school.com/), as well as by contacting the organizer in person. Registrations are binding and will be considered in the order in which they are received. The number of participants in the training and further education program is limited to the number of persons specified in each case. If more registrations are received than there are places available, a waiting list will be kept and the participant concerned will be informed immediately. Any right of withdrawal on the part of the participant remains unaffected.

2.2 Conclusion of contract

In the case of registration via the organizer’s online forms, the participant will receive an email confirming receipt of their registration. The confirmation of receipt is sent immediately after the registration has been sent and does not constitute acceptance of the contract, but merely documents that the registration has been received by the organizer. A contract for participation in the training and further education offer is only concluded by a separate confirmation of registration by the organizer or by the provision of learning materials.

2.3 Multi-part events

A registration is valid for one person for one event or series of events (if booked as such). It is not possible to split participation between several people. Cohort registrations are also expressly possible, but these will only take place via personal contact.

2.4 Admission and enrollment requirements

In order to participate in the training and further education offer, the respective applicable admission requirements must be observed, which will be made available to the participant by the organizer on request. If the training and further education course is an accredited course of study, participation requires enrolment at Saarland University. Enrolment requires the fulfillment of the admission requirements of Saarland University in accordance with the applicable enrolment and admission regulations at the time of enrolment. Subject to the fulfillment of the admission requirements and subject to the availability of study places, the organizer will enroll the participant. However, the participant is responsible for fulfilling and complying with the admission and enrolment requirements and for providing proof thereof. Upon successful enrollment, the participant receives all rights and obligations of students at Saarland University. These obligations include, among other things, that the participant enrols and re-registers each semester on time.

  1. Learning world platform

Once the contract has been concluded, the participant will be registered by the organizer on the organizer’s learning world platform. The participant will receive further information about the course shortly before the start of the course. The organizer’s employees are available to answer questions at any time.

  1. Payment of participation fees

The participant is obliged to pay the remuneration for the training and further education offer on time. The remuneration is based on the prices stated in each case. It is exempt from VAT in accordance with § 4 No. 21, No. 22 UStG. Should the tax exemption cease to apply due to a change in the relevant legal provisions or the opinion of the tax authorities, all prices are subject to the statutory VAT applicable at the due date. Unless otherwise stated, the invoice will be sent as an e-invoice directly to the participant or to the institution on whose account the participant takes part in the training and further education program. Any queries regarding the sending of invoices should be sent to lifecycle[@]scheer-school.com. For payments, the deadlines and instructions stated on the invoice must be observed.

  1. Term, termination, cancellation

5.1 Runtime

The contract for participation in the training and further education program is concluded for the specified duration. The duration generally depends on the academic degree or qualification sought. It ends automatically at the end of the agreed duration without the need for termination. However, the contract does not end automatically if exmatriculation occurs for reasons other than obtaining the desired academic degree or qualification. In this case, the parties (organizer and participant) have an extraordinary right of termination. If accredited study programs are the subject of the training and further education offer, the duration of the contract may be extended at the request of the participant. The organizer shall decide on the application for extension, taking into account the legitimate interests of the participant and the provisions of the Saarland Higher Education Act as amended.

5.2 Termination

The participant’s right to terminate the contract for the training and further education offer prematurely is governed by the following provisions:

  1. Ordinary termination of participation in certificate courses is excluded due to the short duration of the certificate courses.
  2. Ordinary termination of participation in study programs is possible with a notice period of one month to the end of the year.
  3. The right of the parties (organizer and participant) to terminate the contract for good cause remains unaffected. An important reason entitling the organizer to extraordinary termination exists in particular if there are facts that would entitle students of Saarland University to cancel their enrolment in accordance with § 82 SHSG. This is particularly the case if participants
  • the admission was obtained by fraudulent misrepresentation, threats or bribery,
  • the prescribed performance records or examinations are not provided,
  • by using violence, by inciting violence, by threatening violence or by a serious or repeated violation of a lawful order within the scope of domiciliary rights, obstruct the proper operation of a facility of the organizer, the activities of an organ of the organizer or the holding of an event of the organizer or prevent or attempt to prevent a member of the organizer from exercising his rights and duties, use or attempt to use facilities of the organizer for criminal acts.

In the event of effective termination, the obligation to pay remuneration shall lapse with effect for the future from the date on which the termination takes effect.

Any termination must be in text form.

5.3 Cancellation

Cancellation of the training and further education offer by the participant is possible free of charge up to four weeks before the start of the respective event. It must always be made in text form. After expiry of this period, the full participation fee is due if the participant withdraws or does not attend. The right to cancel and the resulting legal consequences remain unaffected by this.

5.4 Personal incapacity, force majeure

If a participant cannot take part in an event of the training and further education program for personal reasons (e.g. illness) or for reasons of force majeure (e.g. weather conditions), there is no entitlement to full or partial reimbursement of the fee.

5.5 Technical requirements

By registering, the participant undertakes to ensure independently that the devices used by him/her meet the technical requirements for (online) participation in the training and further education program.

  1. Hygiene and distancing rules

Participants undertake to comply with the hygiene rules applicable at the time and place of the respective workshops. The organizer reserves the right to ask participants to leave the event or to exclude them from the event if they fail to comply with the applicable regulations.

  1. Cancellation of events

The organizer reserves the right to cancel the respective training and further education offer for organizational reasons, such as an insufficient number of participants or due to force majeure. If the event is canceled by the organizer, the full participation fee will be refunded. Further liability claims or claims for damages are – as far as legally permissible – excluded.

  1. Subject to change

The organizer reserves the right to make changes to the event program. The organizer also reserves the right to make necessary changes to the content, methodology and organization before or during the event, provided that these do not significantly change the benefits of the announced event for the participant.

  1. Arrival

Travel costs are to be borne by the participant and are not included in the participation fee. In the event of exceptions to this rule, separate reference will be made to this point in the event announcement. Arrival and departure must be planned in such a way as to ensure that the event runs smoothly.

  1. Scope of services

Unless otherwise stated, the participation fee includes participation in the event and all necessary event documents. Participants’ costs for hardware required for participation in the events are expressly not included.

  1. Copyright

The documents required for the training and further education offer are made available to the participant in digital form via the organizer’s online platform. The written working material for the events as well as the seminar documents provided in digital form are protected by copyright and may not be reproduced or distributed – not even in part – without the consent of the organizer or the author. No rights of use or exploitation are transferred for purposes other than private use.

  1. Examinations and certificates

12.1. Participants in the training and further education programs must take part in the examinations provided for in the applicable study and examination regulations. For participants in certificate courses, this applies in particular if they wish to have their certificates officially recognized (e.g. in the case of modular recognition in an MSc).

12.2. Participants in the training and further education courses receive a certificate upon successful completion. The certificate of successful participation in certificate courses contains the following information

on the type, duration and aim of the certificate as well as on the skills and knowledge acquired by the participants. The academic degree is awarded by Saarland University.

  1. Data protection

In order to process the registration and to carry out the events, it is necessary for the Scheer School to store and process personal data of the participants of its training and further education offer and to forward it to partner companies (e.g. Saarland University). The processing is carried out – if given by the participant – on the basis of consent in accordance with Art. 6 para. 1 lit. a) GDPR or, if separate consent is not given, on the basis of a necessity for the execution of the contract or to safeguard the legitimate interests of the organizer in accordance with Art. 6 para. 1 lit. b), lit. f) GDPR.   1. Marketing

In this case, consent is required for the production and publication of photos of individual, individually recognizable persons or of video or sound recordings. The processing is based on Art. 6 para. 1 letter a GDPR. It is carried out for the purpose of teaching (e.g. video recordings of events for repetition on the learning platform) as well as for press and public relations work of the Scheer School. The participant will submit a marketing consent form provided by the Scheer School.

14.1. The Scheer School agrees to make its logo available to the participant for co-branding. The cooperation partner is permitted to use content from the

Scheer School for its own internal or commercial (marketing) purposes, as long as the materials are used in their original form or the Scheer School logo and references are clearly recognizable and the origin of the Scheer School as the author is clear.

14.2. The Contractual Partner agrees to be named on the Scheer School’s website or in Scheer School information brochures as a cooperation partner of the Scheer School. As the owner of the rights to its logo, the cooperation partner authorizes the Scheer School to advertise with its logo for the purpose of co-branding. The Scheer School is solely authorized for this purpose,

  1. to use the (brand) name or company name of the cooperation partner with the company address,
  2. to use the company identification and/or the company logo/brand of the cooperation partner,
  3. create a link to the website of the cooperation company.

The declarations of consent pursuant to paragraphs 14.1 and 14.2 above may be revoked in writing at any time.

  1. Right of withdrawal for consumers

If the participant is a consumer, the participant has a fourteen-day right of withdrawal. In this respect, the following applies:

of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail). You can use the attached sample withdrawal form, but this is not mandatory. To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising your right of withdrawal before the withdrawal period has expired.

Consequences of revocation

If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this repayment.

If you have requested that the services should commence during the withdrawal period, you must pay us a reasonable amount corresponding to the proportion of the services already provided up to the time at which you inform us of the exercise of the right of withdrawal with regard to this contract compared to the total scope of the services provided for in the contract.

  1. Final provisions, place of jurisdiction

Should individual provisions of these General Terms and Conditions be or become invalid or unenforceable, this shall not affect the validity and enforceability of the remaining provisions. In this case, the parties shall replace the invalid or unenforceable provision with a valid and enforceable provision that corresponds as closely as possible to the intended legal and economic purpose of the provision to be replaced. The above provision shall apply accordingly in the event of contractual loopholes.

The place of jurisdiction is – as far as legally permissible – Saarbrücken.
